1. Acceptance of Terms

By accessing or using MeshBoard (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Account Registration

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and promptly update it if it changes. You must be at least 13 years old to create an account.

3. User Content & Ownership

You retain ownership of all content you upload to MeshBoard, including 3D designs, images, comments, and other materials (“User Content”). By uploading User Content, you grant MeshBoard a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as necessary to operate the Service.

You represent that you have the right to upload any content you submit and that your content does not infringe on the intellectual property rights of any third party.

4. Design Remixes & Attribution

MeshBoard allows users to remix (fork) existing designs. When you remix another user’s design, the original designer is automatically credited. By uploading designs to MeshBoard, you acknowledge that other users may remix your work with attribution. You may not remove or obscure attribution on remixed designs.

5. Tips & Payments

MeshBoard offers a tipping feature that allows users to send monetary tips to designers. Tips are voluntary and non-refundable once processed. Payment processing is handled by Stripe, Inc. MeshBoard may charge a platform fee on tips, which will be clearly disclosed before any transaction.

You are responsible for any taxes applicable to tips you send or receive. MeshBoard is not responsible for disputes between users regarding tips or payments.

6. Prohibited Conduct

You agree not to:

• Upload content that infringes on others’ intellectual property
• Upload malicious files, malware, or harmful content
• Harass, threaten, or abuse other users
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or other users’ accounts
• Spam, phish, or engage in deceptive practices
• Circumvent any security features of the Service
• Use automated tools to scrape or collect data from the Service

7. Intellectual Property & DMCA

MeshBoard respects intellectual property rights. If you believe your copyrighted work has been uploaded without authorization, you may submit a DMCA takedown notice by contacting us at the email address below. Please include:

• Identification of the copyrighted work
• Identification of the infringing material and its location on MeshBoard
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. MeshBoard does not warrant that the Service will be uninterrupted, error-free, or secure. We do not endorse or guarantee the quality, safety, or printability of any user-uploaded designs.

9. Limitation of Liability

To the maximum extent permitted by law, MeshBoard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you have paid to MeshBoard in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless MeshBoard and AIPOTHERY LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, though certain provisions of these terms will survive termination.

12. Changes to Terms

We may modify these terms at any time. We will notify users of material changes via the Service or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in Loudoun County, Virginia.
